We understand the importance of managing client expectations through frequent and on-going communication and begin by asking clients about the surrounding facts and circumstances, the relevant business considerations, the ultimate goal and the budget. After formulating the best legal strategy for the case, we discuss this strategy with the client or co-counsel and make necessary adjustments. A litigation budget is then prepared and submitted to the client for approval. Depending on the nature of the subject matter, we may involve experts to evaluate claims, defenses and damages.
Following this initial conference, we investigate the facts by reviewing key documents and interviewing critical witnesses. Simultaneously, we explore legal theories that will advance the client’s interests. All claims are evaluated by examining the legal basis for the claimant’s position and an evaluation of potential defenses that would either negate or offset a portion of the damages.
When appropriate, we employ junior level lawyers to perform legal research and draft research memoranda for more senior lawyers and partners, who then prepare initial evaluations and recommendations for clients.
